Terms of Service & Subscription Agreement

By checking the box at checkout, you ("Teacher" or "Subscriber") agree to these Terms with the individual or entity operating Math Battle ("we," "us," or "Company"). Please read them carefully.

1. Acceptance of Terms

By purchasing a subscription and checking the acknowledgment box, you confirm that you are at least 18 years old, have the authority to agree to these Terms on behalf of yourself or your institution, and have read and understood this agreement in full.

2. Subscription & Billing

Math Battle is offered on a subscription basis. Your subscription begins on the date of purchase and renews automatically at the end of each billing period unless cancelled. You may cancel at any time through your account settings or by contacting us at andy@joinmathbattle.com. Cancellation takes effect at the end of your current billing period — you retain access through that date.

All subscription fees are non-refundable. No partial or prorated refunds are issued for unused time, early cancellation, or any other reason. We do not offer retroactive refunds for any prior billing period under any circumstances.

3. Educational Use & Compliance

Math Battle is intended for use in classroom and educational settings. By subscribing, you represent and warrant that:

• You are using the platform in compliance with all applicable federal, state, and local laws, including FERPA and, where applicable, COPPA.
• You are responsible for obtaining any parental or institutional consent required before having students interact with the platform.
• You will not use Math Battle to collect, store, or transmit sensitive personal information beyond what is required for ordinary classroom use.
• Student accounts and activity are managed at your direction. You are the responsible party for how the platform is used within your classroom.

4. Data Tracking & Gradebook Features

Math Battle provides data tracking features — including student scores, session history, and gradebook analytics — as a convenience feature only, provided on a best-effort basis with no guarantee of accuracy, completeness, or availability. You acknowledge and agree that:

• Data may be lost. Student scores, session history, and gradebook entries may be lost, corrupted, or unavailable due to technical failures, third-party service outages, software bugs, or other causes beyond our control.
• Data is not guaranteed to persist for any specific period.
• Do not rely solely on Math Battle for grading. Maintain your own independent records. Math Battle data is a supplementary reference, not an authoritative gradebook.
• We are not liable for any academic, administrative, or professional consequences arising from data loss, inaccuracy, or unavailability.

5. Limitation of Liability

To the fullest extent permitted by applicable law:

• Math Battle and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or harm arising from reliance on platform features.
• Our total liability for any claim shall not exceed the amount you paid in the three (3) months preceding the claim.
• We are not responsible for outages or data loss caused by third-party services (including Firebase, hosting providers, or internet infrastructure).

6. No Warranty

Math Battle is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or uninterrupted access.

7. Changes to the Service or These Terms

We reserve the right to modify, suspend, or discontinue Math Battle or any feature at any time, with or without notice. We may update these Terms at any time. Continued use of the platform after changes are posted constitutes acceptance of the revised Terms.

8. Governing Law

These Terms are governed by the laws of the State of Minnesota, without regard to its conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Minnesota, and you consent to personal jurisdiction in those courts.
